Being on probation puts you in the challenging position of evaluating each of your actions and determining whether they violate the terms of the probation. Probation terms can vary significantly, and while some are easy to avoid, others are possible to violate without necessarily intending to do so. If you've been arrested for violating the terms of your condition by traveling out of the state, you may be looking at jail time. Talk to your criminal defense attorney about your reason for doing so, and he or she may be able to present a compelling defense on your behalf. Here are some potential reasons.
An Emergency Situation
It may be possible that you left the state because of an emergency, and your mind was so preoccupied with the situation that you failed to think about the legal ramifications of crossing state lines. For example, if you had a child who was playing in a sports tournament in an adjacent state, and you received a phone call stating that the child was injured during his or her game and was now at the hospital, you might have dropped what you were doing and rushed to the hospital, too. Your attorney will argue that your compassionate nature was responsible and that you were not trying to disobey the rules of your probation.
Geographical Challenges
There's a chance that you ended up getting lost while driving or even hiking, and ended up crossing state lines without knowing it. For example, if you were on a hiking day trip and got turned around, you may have walked across the border between two states. If you ended up having contact with the police in the state to which you've arrived, they could run a background check and determine that you were in violation of your probation by being there. If you were legitimately lost, this may be a defense that your attorney can work with.
Against Your Consent
Sometimes, you could find yourself in a different state without having given consent. A prime example could be when you were a passenger in a vehicle. For example, if you were sleeping in the backseat of a car that your friend was driving, and he or she decided to cross state lines, the friend may not have woken you to discuss this plan. If he or she was pulled over and the police officer checked your ID, you might be found in violation of your probation.
